The Inmate Appeals Process

Administrative Remedies are a form of dispute resolution used by the Bureau of Prisons (BOP) to allow inmates to contest a decision affecting their treatment. It is used when an inmate feels a mistake of procedure or judgement has been made by staff against their interests or personal concerns. It can be because of a mistake by a guard, a withdrawal of visitation privileges, an inappropriate punishment, poor medical treatment, disqualification from a sentence reduction program, or any action or inaction resulting in the grievance. It can be utilized by any inmate in a federal BOP facility, a contract prison facility, or federal Halfway House. It involves a series of up to four (4) separate Appeals in steadily escalating steps presented to the appropriate BOP personnel, any one of which is a decision-maker that can overturn the improper decision made by the BOP and resolve the situation. Administrative Remedies are meant strictly as an in-house procedure not involving the courts.

The Prison Consulting Group LLC (PCG) prepares these Administrative Remedies in the order it is necessary under the Bureau of Prisons’ Policies and Procedures with meticulous research, attention to detail, and utilizing all arguments and evidence on behalf of the inmate. When any given step in the Administrative Remedy series achieves success, a Request is decided in the inmate’s favor. The BOP cannot overturn a favorable outcome for the inmate. If a Request does not yield the proper decision, the next step is initiated and Prison Consulting Group takes the process to the next level and they initiate a review of the complaint. The entire process, if necessary, starts at the inmate’s Unit Team level in his institution, and can progress from there to the Warden, then the BOP’s Regional Director, and up to the Central Office in Washington, DC. The work must be complete at each step and include all appropriate documentation, continuation sheets, and exhibits in the submission. These may be forms and documents that the inmate may not even have access to. We do. In addition there are strict timelines that must be met or the BOP denies your request as not timely submitted. PCG knows the timelines, knows the procedures, and knows how to prepare an Administrative Remedy Appeal specifically designed for the circumstances of the individualized inmate.
